TERMS OF SERVICE

1. Acceptance of Terms

By downloading, installing, or using Zephr ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the App. The App is developed and maintained by Derek Lei ("we," "us," or "our").

2. Description of Service

Zephr is a macOS menu bar application that provides AI-powered text rewriting. The App allows you to select text anywhere on your screen and rewrite it using various AI providers and models. The App requires macOS 14 (Sonoma) or later and supports both Apple Silicon and Intel processors.

3. Free and Pro Tiers

3.1 Free Tier

The free tier provides limited access to the App’s features, including a limited number of rewrites per day using the built-in Zephr model. No account or email registration is required.

3.2 Zephr Pro

Zephr Pro is a paid subscription at $5.99 USD per month that unlocks additional features and higher usage limits. Subscriptions are billed monthly through Stripe. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

3.3 Bring Your Own Key

The App allows you to configure your own API keys for third-party AI providers (such as OpenAI, Anthropic, Google, xAI, and OpenRouter) as well as local models. Use of third-party providers is subject to their respective terms and pricing. We are not responsible for any charges incurred through your use of third-party APIs.

4. Payments and Refunds

All payments for Zephr Pro are processed by Stripe. By subscribing, you authorise recurring monthly charges to your payment method. We do not store your payment card information.

Refund requests may be considered on a case-by-case basis. To request a refund, please contact us at zephr.app@gmail.com.

5. Acceptable Use

You agree not to use the App to:

• Violate any applicable law, regulation, or third-party rights.
• Generate, rewrite, or distribute content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Attempt to reverse-engineer, decompile, or disassemble the App or its underlying systems.
• Circumvent, disable, or interfere with any usage limits, subscription verification, or security features of the App.
• Use automated means to access or abuse the App’s API proxy beyond normal individual use.

6. Intellectual Property

The App, including its design, code, branding, and documentation, is the intellectual property of Derek Lei and is protected by applicable copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal or professional purposes in accordance with these Terms.

You retain full ownership of the text you input and any rewritten output generated through the App.

7. Third-Party Services

The App integrates with third-party AI providers and services. Your use of these services is governed by their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or output quality of any third-party service.

8. Updates

The App uses Sparkle to deliver automatic updates. By using the App, you consent to receiving updates that may include bug fixes, new features, or changes to functionality. We may modify or discontinue features at our discretion.

9. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. AI-generated output may contain errors, inaccuracies, or unintended content. You are solely responsible for reviewing and verifying any rewritten text before use.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Derek Lei shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the App, regardless of the theory of liability.

Our total aggregate liability to you for any claims arising from or related to the App shall not exceed the total amount you have paid for Zephr Pro in the twelve (12) months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your access to the App or any of its features at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the App ceases immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Melbourne, Victoria, Australia.

13. Changes to These Terms

We may revise these Terms at any time by updating this page. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
